Re: The Judicial Vacancies “Crisis”

by Ed Whelan

Statistics from the Administrative Office of the U.S. Courts reinforce my position that confirming appellate nominees would not be an intelligent response to the asserted “crisis” of judicial vacancies. In particular, as this table shows, the aggregate number of appeals filed in the federal appellate courts fell a remarkable 19.3% from 2006 to 2010, and the aggregate number of appeals pending fell 18.9% during the same period.
