I was prepared to say more along the lines of what I have said in the past on this subject, but I see that David French has covered the ground thoroughly over at The Corner.  Andrew Napolitano, by contrast, has an analysis distinguished only by being wrong about absolutely everything, a veritable primer of comprehensive wrongness.
