A Nuclear Winter for Nominations?

by Jonathan H. Adler

Senate Majority Leader Harry Reid is threatening to invoke the nuclear option so Senate Democrats can confirm President Obama’s D.C. Circuit nominees by a simple majority vote.  I offer my thoughts on this threat at the VC.  My bottom line: I’d prefer a deal like that which broke the impasse over President Bush’s Michigan nominees to the U.S. Court of Appeals for the Sixth Circuit, but ending the de facto super-majority requirement for judicial nominations would be a good thing however it is done — and I’m sure the next President will appreciate it.
