Liu v. Alito

Professor Goodwin Liu’s testimony referenced by Ed Whelan below is available here.  In it, as Ed descrbies, Prof. Liu allegged that then-Judge Alito was “at the margin, not the mainstream,” and that the America envisioned by Judge Alito’s judicial record was “not the America we know. Nor is it the America we aspire to be.” Prof. Liu also co-authored this report on Judge Alito’s record in capital cases for the American Constitution Society.  For more on Professor Liu’s approach to constitutional interpretation, see also his co-authored ACS book, Keeping Faith with the Constitution.
