For Whom to Have Empathy?

Carson Holloway, blogging at Catholic Vote, wonders (among other things) how Obama-style judges will choose when there is more than one party who makes a claim on their empathy.  Is there a principle of choice that could be called “lawful” under those circumstances?  Good question.  After all, cases have two parties.
