No sitting justice has announced any plans to step down, but that doesn’t stop speculation about who President Obama might nominate for the High Court. Tom Goldstein of SCOTUSBlog, whose speculation is likely more informed than most, identifies four possible nominees were a justice to retire this summer: Solicitor General nominee Elena Kagan, Second Circuit Judge Sonia Sotomayor, Seventh Circuit Diane Wood, and (as a “sleeper candidate”), Michigan Governor Jennifer Granholm.
Meanwhile, the Sioux City Journal picks up on the Bazelon-Resnick suggestion that Obama elevate Iowa district court judge Mark Bennett (also discussed here). Yet between his age (58), and the fact there are no current or pending vacancies on the U.S. Court of Appeals for the Eighth Circuit, this seems unlikely to me. (Hat tip: How Appealing)
