Getting the Numbers Right


I now see that the Federal Judicial Center database includes among President Bush’s federal appellate appointees Charles Pickering, who served as a recess appointee to the Fifth Circuit for 11 months in 2004.

The number of President Bush’s Senate-confirmed lifetime appointees to the federal courts of appeals is therefore 61 (not 62, as I have previously stated), compared to 65 for President Clinton.  (And, if you include recess appointees for both, the numbers are 62 for Bush versus 66 for Clinton.)
