A quick follow-up to last week’s post:  The Supreme Court today issued an order declining to grant review of the D.C. Circuit’s decision in the Abigail Alliance case.  (Overturning a panel decision, the en banc D.C. Circuit ruled—correctly, in my judgment—that the Constitution does not confer a right for terminally ill persons to have access to experimental drugs that have passed the FDA’s Phase I clinical testing.)
