Justice Koh?


The Yale Daily News reports that Yale law school dean Harold Koh would be a leading contender for a Supreme Court nomination if a Democrat wins the White House in 2008.  Given Koh’s evident willingness to sign his name to anything, no matter how legally baseless, that advances his leftist political agenda (such as, to cite but one example, the ABA’s report on presidential signing statements, which I discuss here), he would be a natural choice.  He also would score diversity points, as the Supreme Court has never had a champion of transgender causes.
