A Clarification: No Prediction on Vacancy


At the National Review Institute’s Conservative Summit this past weekend, I briefly explained (as I did in this post-election essay) why a strong Supreme Court nominee could be confirmed if a vacancy arises during the remainder of President Bush’s term in office.  At least one account has misattributed to me the view that there is a “strong chance” that there will be another vacancy during that period.  I did not opine on that issue.
