The AP is reporting that three of President Bush’s appellate nominees — William Haynes, William Myers and Terrence Boyle — have told the White House that they do not wish to be renominated. All three were opposed by Senate Democrats. Another nominee, Michael Wallace, recently withdrew as well. This means that six Bush nominees to the appellate bench — the aforementioned four, plus Miguel Estrada and Carolyn Kuhl — withdrew due to Democratic opposition, despite a GOP majority in the Senate. This does not bode well for Bush judicial nominees’ prospects during the next two years.
