Status Report on Wallace Hearing -- Part 2


The ABA panel is now testifying.  The new chair of the ABA Committee on Federal Judiciary, Roberta Liebenberg, has just told—and repeated several times—a flat-out lie:  she claims that Stephen Tober, the former ABA committee chairman who had manifest animus for Wallace, “did not participate in the evaluation or rating” of Wallace.  Yes, Tober did not cast a vote, but, consistent with the ABA’s express procedures, he reviewed the draft report that the Fifth Circuit member, Kim Askew, prepared and he had to be “satisfied with the quality and thoroughness of the investigation” before the formal report would be circulated to the other committee members.  He also selected the person who conducted the second review of Wallace.
