CQ Today’s coverage of yesterday’s special business meeting in the Senate Judiciary Committee includes this little tidbit:
Ranking member Patrick J. Leahy of Vermont, the only Democrat to attend Tuesday’s session, noted that Republicans who now want to add [Bush nominee Peter] Keisler to the D.C. Circuit had claimed that the court contained “too many judges when it was a Democratic president.”
Lindsey Graham, R-S.C., noted that pending legislation that would establish military tribunals for terror suspects would make the court the venue for appeals and significantly increase the court’s caseload.
“That could result in hundreds of cases into this court,” Graham said.
