No Case for Holding Keisler

At ConfirmThem, Andrew Hyman dissects Senators Sessions and Grassley’s alleged concerns over confirming Peter Keisler to the U.S. Court of Appeals for the D.C. Circuit. Apparently both have voted to place an eleventh judge on the court before (Griffith), and one of the current judges (Judith Rogers) is reportedly preparing to take senior status.  Thus, all that a delay would accomplish is keeping Keisler from the bench, as there is no guarantee he could be confirmed in the next Senate.
