Re: Novak on Livingston


Jonathan, I am reliably informed that Robert Novak had it wrong:  Second Circuit nominee Debra Livingston is not a friend of White House Counsel Harriet Miers.  In fact, Livingston and Miers have met only once—during Livingston’s White House interview for a judgeship. 

Novak’s account also misses the fact that the unanticipated announcement by Second Circuit Judge John Walker that he would take senior status made it possible for the President to nominate both Livingston and Peter Keisler—Livingston to the Walker seat (in the circuit in which she has spent almost the entirety of her professional career) and Keisler to the D.C. Circuit.
