Is Boyle in Trouble?

The News & Observer reports that allegations of ethical improprieties by Judge Terrence Boyle, specifically failing to recuse himself in a handful of cases, “have strengthened Democrats’ resolve to fight his promotion and raise doubts about whether the North Carolina judge’s nomination will ever get a full vote in the U.S. Senate.” The story also repeats cryptic remarks by Senator Kyl that one or more pending nominees may “drop out” so others may get through. Said Kyl, “We’ll take care of the ones who’ve been nominated with one or two exceptions.” Is Boyle one of the “exceptions”? If not, who is?
