Partial-Birth Abortion Act Case

by Jonathan H. Adler

The Supreme Court did in fact grant certiorari in one of the cases challenging the constitutionality of the federal Partial Birth Abortion Act. The federal ban has been struck down by three federal appellate courts — the Second, Eighth and Ninth Circuits. The petition granted was from the Eighth Circuit, and the case will be argued next fall. For more on the cases, see SCOTUSBlog and How Appealing.
