A Telling Omission?

by Jonathan H. Adler

Asked about the ABA’s unanimous “well qualified” rating of Judge Alito, Senator Schumer said that the ABA was only “the gold standard for the two things they measure, competence — in other words, their qualifications — and their judicial temperament.” Noticeably absent from Schumer’s statement is any reference to ethics and integrity. Perhaps this was unintentional. More likely, it is further indication that Senate Democrats will seek to attack Alito’s “credibility” and integrity rather than his judicial philosophy.
