I am a big fan of John Yoo’s, and I agree with most of his points; however, I must say that many of us simply did not see the Schiavo matter as federalism issue, given Article III and the Fourteenth Amendment. We’ve debated this at length before, but I feel it’s necessary to reiterate. And as for Congress telling the federal courts what to do, the objection, if there is one, is a separation of powers issue.
