Peter, I don’t think that factoring in the Supreme Court should change the judgment that the Right has more at stake in this election than the Left, for two reasons. First: Republican appointees are more likely to disappoint their sponsors than Democratic appointees are. Second: While there are important exceptions, in general it is true that a conservative majority on the Court would leave liberals free to win policy victories in legislatures, while a liberal majority would make conservative legislative victories impossible.
