Andy writes that “if we didn’t have a death penalty, the Left would be arguing that life imprisonment and other lengthy sentences are violations of the 8th Amendment.” I’ve heard this argument before from proponents of the death penalty and been skeptical. But I think the case being considered by the Supreme Court — on the constitutionality of life sentences without the possibility of parole for minors — strengthens the case that life sentences would indeed be next on the target list.
