Millions of Dollars and Dozens of Bureaucrats for Disparate-Impact Lawsuits


The Justice Department’s proposed budget for the civil-rights division includes an additional “$1.5 million and 12 positions (10 attorneys)” for an “Employment Initiative” that seems aimed at bringing more disparate-impact employment lawsuits, and an additional “$2.1 million and 22 positions (12 attorneys)” for “Discrimination in Lending and Foreclosures,” likewise for disparate-impact housing lawsuits. I’ve flagged the folly of the disparate-impact approach many times, most recently here for employment and here for housing.
