Via Der Spiegel, here’s yet another reason to feel just a little sorry for Angela Merkel:

A Hamburg judge has filed a criminal complaint against Chancellor Angela Merkel for “endorsing a crime” after she stated she was “glad” that Osama bin Laden was killed by US forces…Hamburg judge Heinz Uthmann…alleges that the chancellor’s statement was nothing short of illegal, and filed a criminal complaint against Merkel midweek, the daily Hamburger Morgenpost reported Friday.

 “I am a law-abiding citizen and as a judge, sworn to justice and law,” the 54-year-old told the paper, adding that Merkel’s words were “tacky and undignified.”

 In his two-page document, Uthmann, a judge for 21 years, cites section 140 of the German Criminal Code, which forbids the “rewarding and approving” of crimes. In this case, Merkel endorsed a “homicide,” Uthmann claimed. The violation is punishable by up to three years’ imprisonment or a fine.

 “For the daughter of a Christian pastor, the comment is astonishing and at odds with the values of human dignity, charity and the rule of law,” Uthmann told the newspaper.  

Free speech is evidently not something that weighs very much with the repellent Judge Uthmann, a sanctimonious, posturing thug with no place in the judiciary of any country that puts a value on freedom of expression. Then again, in today’s EU freedom of expression is not something that counts for very much . . .

I guess Justice and Law trump freedom, liberty, opinion and everything else according to this Judge. It is war, and the opposing ring leader received Justice, long over due.

Imagine that, 3 years for saying she was glad Osama was done in. How many for Merkel if she had taken part? I wonder how long people will stomach morons like this judge?

Is it illegal to endorse an action that is a crime where committed, or an action that would be a crime if committed in Germany? If a woman in a country that mandates the burqa shows her face in public, is a German allowed to cheer?

Either way, I hope no Germans have made the mistake of endorsing the attacks on Libya.

Mr. Stuttaford you do make me realize what a toxic, foul, fascist style environment many European politicians work in. Sometimes with their people and culture so degenerated I should be glad the European politicians aren't worse than they are instead of wondering why they can't be better.

My God this "judge" just assumes that it is natural that anything that offends him is automatically a crime! Society should be protected from such as HIM...

I'm sure judge Uthman filed a similar complaint when any German news commentator said anything positive about Wikileaks, illegal Greek or French protestors, etc. I wonder if he would file a complaint if someone said something positive about the crimes of the White Rose society?

It's also illegal in Germany to say anything that could be construed as supportive of Nazism. So how could a German legally answer the question, "Are you glad Hitler is dead?"

A no answer would be an illegal endorsement of Nazism and the Holocaust. A commonsense yes answer would now apparently be an illegal celebration of what is a terrible tragedy, cough, cough, the death of a human being.

So a German cannot legally answer the question at all - and even a refusal to answer could be construed as a tacit endorsement of one illegal stance or the other.

I hope Germany has an "I am Spartacus" moment, with thousands of people repeating Merkel's words in public, on tv, in print, in letters to this clown, etc., so that the buffoon is forced to drop his kangaroo-court charges against Merkel.

I'll say it here in America: I'm glad bin laden is dead. I'm also glad Hitler, Mao, Stalin, Lenin, Arafat, Mussolini, DC sniper John Allen Muhammad, and Khan (both Genghis and Noonien) are dead. Heinz Uthmann be damned.

p.s. I'll bet a case of Guinness that Uthmann voted for Merkel's opponent in the last election. Any takers?
