I could add to my post all day, but will lay just one P.S. on you. Some years ago, there was a big battle between Netscape and Microsoft. Both sides sought Bob Bork’s support, as well they might have, because he was the leading antitrust scholar in the country. Bob examined both sides and sided with Netscape.
Now, almost every other legal mind I respected was with Microsoft. This put me in a quandary: “A hundred legal eagles I like say Microsoft is right; Bob says Netscape is right. How am I to know?”
That was the power of Bork’s mind, for me. A hundred to one, with Bob being the one, was just about a fair fight.
