The cases against the Free Birth Control Rule, based primarily on the Religious Freedom Restoration Act, have been generally going well for the challengers. The one truly egregious exception has been Hobby Lobby, which is currently defying the government at the risk of who knows how many millions in fines.
Showing how important these cases are, the 10th Circuit Court of Appeals agreed to hear the case en banc (a 9 instead of 3-judge panel) on an expedited basis. Let’s hope the Court of Appeals judges have better legal sense than the trial court!
