GOP Senators Continue to Push Enemy-Combatant Status for Tsarnaev

Republican senators hit the news shows last night to insist the Obama administration made the decision to not consider Dzhokhar Tsarnaev an enemy combatant too quickly, particularly for the purposes of getting more information about possible future attacks.

On The Kudlow Report last night, Kelly Ayotte voiced those concerns. “I really think this is so wrong, because we owe it to the American people to find out what he knows to make sure we can protect them,” she said. “Unfortunately, their decision to go immediately down the federal-trial route and not hold him as an enemy combatant to find out what he knows . . . is not good in terms of making sure we have everything we need to protect the nation.”

On Fox News, Lindsey Graham told Greta Van Susteren that it was “ridiculous” to make the decision to try Tsarnaev as a criminal just three days after his capture, especially with so many unanswered questions. “What I want is pretty simple: I want to be able to talk to him without a lawyer present to gather intelligence about future attacks that may come our way,” Graham said, adding that information would not be used against Tsarnaev in a criminal court.

Graham also said he’s not worried about Tsarnaev being convicted in a criminal court. “A first-year law student can convict this guy,” he said.
