The Texas case Mailee Smith writes about below demonstrates how the federal courts oversee every aspect of any abortion law passed by a state legislature if abortion-rights activists file a case. It also demonstrates the public-health vacuum created by the Supreme Court in Roe and Doe: The Court has still never approved first-trimester health and safety regulations, the period of pregnancy when 90 percent of abortions are done. And this case shows the lack of Supreme Court guidance provided in 1973 and ever since.
