Justice Scalia and Climate Change

At The New Republic, Simon Lazarus argues that Monday’s decision in a climate-change case shows that seven members of the Supreme Court, including Justice Scalia, generally approve of the administration’s climate-change policy. I suspect that in the spectrum of opinions on what our climate policy ought to be, Scalia falls somewhere between Jim Manzi and Jim Inhofe — and that his opinion reflects his views about what the administration may do consistent with statute, not what it should do. Some people do think about the law that way.
