Today the Supreme Court finally handed down its decision in the mammoth health care case and it’s a win for the states and private plaintiffs. The Court found the mandate unconstitutional and struck it down along with the law’s central health insurance regulations. While I haven’t had a chance to read the full decision yet, I will post a summary as soon as possible.
It is heartening that the Court has reaffirmed the importance of the Constitution’s limits on government power as the basis for individual liberty. And it is reassuring to know that the Chief Justice and Justice Kennedy weren’t swayed by the repeated attempts by the media and even the president to malign them as activists for following the Constitution rather than reading off his talking points. I hope Congress will learn from the debacle of this law and search for answers to our health care problems don’t run roughshod over the individual rights protected by the Constitution.
