Some of my fellow bloggers here know Douglas Kmiec. I do not. But it seems to me that he has completely turned his coat. His transformation from Reagan man and Catholic pro-lifer is now total. All lip service to commitments once central has evidently been dropped. Giving an interview to CNSNews.com, Kmiec spoke for Barack Obama’s judicial preferences as he understands them, praising David Souter and Stephen Breyer, and predicting that among Obama’s possible nominees to the Court could be such left-wing academics as Cass Sunstein, Elena Kagan, and Harold Hongju Koh.
None of this is really news, of course. Our own Ed Whelan has made similar observations and predictions. And I suppose we should appreciate Douglas Kmiec’s candor. Somehow it would be more reassuring to believe that Kmiec was and remains deluded about Obama’s full-fledged membership in the party of death. In joining in his candidate’s enthusiasm for Justices Souter and Breyer–and in backing such probable appointees as Sunstein, Kagan, and Koh–Douglas Kmiec has earned his own lifetime membership card in that party.
