Ed provides a link just below to the full transcript of Greenburg’s interview with Chief Justice Roberts. Only a fraction of it was aired on Nightline, and by no means the most interesting parts—so it’s good to see the whole thing.
By the way, a correspondent comments on my posting about the Chief’s habit of writing in longhand: “Re whether the way in which you draft an opinion relates to, well, anything at all: Roe v. Wade was drafted in longhand.” Point well taken. Of course, foolish is as foolish does: nothing was going to make Harry Blackmun get anything right in that case. I still think that any practices that facilitate over-reliance on the clerks is a dubious form of “progress,” and any practice that keeps the clerks at arm’s length from opinion-drafting is probably good.
