The Hill is reporting that two Republicans, Senators Grassley and Sessions, are holding up the confirmation of Peter Keisler to the U.S. Court of Appeals for the D.C. Circuit.
Update: The text of the article (which was not available on-line before) explains that the two Senators’ concern is not with Keisler himself, but with whether there needs to be an 11th judge on the D.C. Circuit. Both Senators argued that the court only needs ten judges in the past, even though there are twelve slots. One possible compromise would be to confirm Keisler in exchange for officially reducing the D.C. Circuit to eleven judges.
