On behalf of the Ethics and Public Policy Center (my institutional home for more than two decades), I have submitted an amicus brief in support of the state of Louisiana’s challenge to the FDA’s lax regulation of the abortion pill. The amicus brief shows that the FDA’s elimination of the in-person dispensing requirement dramatically increases the severe health risks that mifepristone-induced abortion poses. It also explains that the Comstock Act broadly prohibits mailing abortion drugs, irrespective whether those drugs are to be used for lawful or unlawful abortions.
