“If a case is pending, shut up.”
That was Dahlia Lithwick’s succinct advice to Supreme Court justices a decade or so ago. Although it doesn’t exactly capture the contours of 28 U.S.C. 455(a) (which allows comments that don’t call into question a justice’s impartiality), it’s advice that Justice Ginsburg certainly should have followed.
