Earlier today, the Senate Judiciary Committee favorably reported Caitlin Halligan’s nomination to the D.C. Circuit by a 10-8 vote.
Meanwhile, here’s another sign of how underworked D.C. Circuit judges are: D.C. Circuit judge Brett Kavanaugh will be sitting by designation on a Ninth Circuit panel tomorrow. (It’s common for senior judges to sit by designation on other circuits, but much less so for judges like Kavanaugh who are in regular active service.)
