Judge Floyd to the Fourth?

Earlier today President Obama nominated South Carolina district court judge Henry Floyd to the U.S. Court of Appeals for the Fourth Circuit.  As the BLT reports, Judge Floyd gained national attention in 2005 for ruling that the Bush Administration exceeded its authority when it sought to hold Jose Padilla as an “enemy combatant,” a decision that was later overturned by the court to which Judge Floyd has been nominated.
