Justice Stevens’s Unplugged Tour

Justice Stevens is no longer casting votes on the Supreme Court, thank goodness, but that hasn’t stopped him from serving as a surrogate for whatever left-wing agenda item captures his attention.  In the most recent edition of Justice Stevens Unplugged, coming via The National Law Journal (paywall), he calls on the Senate to confirm Merrick Garland and laments as “unfortunate” the fact that he has not yet been confirmed.  In other words, one of the justices responsible for turning the Supreme Court into a supremely political institution is now concerned by the fact that the confirmation process involves politics.  Perhaps someday he will surprise us all by explaining that the Court’s reputation and authority would be enhanced, and the confirmation process simplified, if people like himself stopped behaving as though every aspect of American life ought to be engineered by nine lawyers.
