Dionne Jr. hallucinates about the threat posed by the phantom “Constitution in Exile movement”—that “judges appointed during the right’s ascendancy [will] be able to block, frustrate and undermine the efforts of a new progressive majority.” I recently addressed Jeffrey Rosen’s similar piece (which Dionne quotes) here, and explained here that the real threat to democratic self-government would come from Obama appointments to the Court.
