No to Justice Thomas

Sidney Thomas, that is. The Ninth Circuit judge from Montana, appointed by President Clinton in 1996, is reportedly one of ten or so candidates being seriously considered by the White House for the Stevens vacancy.

I’m pleased to say that, trying to anticipate the White House’s thinking, I put Judge Thomas on my list of possible candidates last fall. My initial review revealed that (unlike some other Clinton appointees to the Ninth Circuit, such as Margaret McKeown and Susan Graber) Thomas is on the far Left of that far-Left court. He may be physically in Montana, but he’s jurisprudentially in Reinhardt-istan.  (I may find time to present a detailed review of his record soon.)
