Today, the Supreme Court ruled 6-3 that the Controlled Substances Act does not give the federal government the authority to preempt Oregon’s doctor-assisted suicide statute. Chief Justice Roberts joined Justice Scalia’s dissent, marking this the first time Justice Roberts has dissented as Chief Justice. As longtime NRO readers know, while I’m no fan of Oregon’s law, I believe the Supreme Court got this one right.
