We at Bench Memos spend most of our time discussing abstract legal principles like the separation of powers and original meaning. And we do that unapologetically because these principles are the foundation for the rule of law and the constitutional order.
But sometimes it’s also helpful to step back to recognize why the principles are so important: they protect real people. As Carrie Severino noted, yesterday the Supreme Court decided Horne v. Department of Agriculture. The case was not only a reaffirmation of the important constitutional rule protecting private property from government redistribution; it was also vindication for the Hornes and the small California farm depicted in the following video.
Congratulations to the Hornes on their victory – at last! – and sincere thanks for helping preserve the property rights of all Americans.
