Rasmussen released a poll earlier this week, asking likely voters their views of the Supreme Court. The numbers are surprisingly stable from the last iteration of these questions in May, and indicate that a majority of likely voters (60 percent in the most recent poll) believe that judges should make their decisions based on the Constitution and legal precedent rather than a (often hard-to-articulate) sense of fairness. Unfortunately only 38 percent believe the courts actually do base their decisions on legal rationales. And as long as senators continue to support nominees like Louis Butler, Robert Chatigny, John McConnell, and Goodwin Liu, the disconnect between the approach of the court and what the American people want won’t get any narrower.
