Senator Scott Brown, who hails from Elena Kagan’s adoptive home state of Massachusetts (Brown and John Kerry introduced Kagan at her hearing), has just announced that he will vote against Kagan’s nomination.
Since my tally yesterday, Senators Bond, Brown, Brownback and Cochran have stated their opposition to the Kagan nomination (and Senators Conrad and Lincoln have declared their support for Kagan). Senator Enzi is also a likely no, so that would make 37 no votes (one Democrat and 36 Republicans), with Democratic senator Webb still to be heard from.
