Tomorrow, I will be participating in a debate with Professor Jeffrey Rosen of George Washington University on the topic of “Judicial Activism: Is It Just in the Eye of the Beholder?” at the Heritage Foundation at noon. Judge Susan Braden of the U.S. Court of Federal Claims has kindly agreed to moderate the event.
Rosen is widely credited with launching the public conversation concerning whether the Roberts Court is an activist, pro-business court with his 2008 New York Times Magazine article, Supreme Court Inc., and so it promises to be a lively exchange.
