the nominee asserts law to govern the nonelite public at large: approval of a Supreme Court nominee with a counterintuitive and racist position negating the commonly-accepted criteria of merit, scholarship and judicial temperament, whereas the nominee herself, for her own staff, selects on quite another basis than that which she seeks to impose upon the public.  This is established by the fact that the vast majority of Judge Sotomayor’s law clerks over many years have been non-Latinas. In a letter to Senate leaders signed by the nominee’s former law clerks, of the 45 signatory names appearing, only three surnames, or 6.23%, are even arguably “Latina/Latino.”
