Senator Grassley devoted his questioning to takings cases (Kelo and Didden) and environmental cases. I’ll be interested whether those expert in Didden are persuaded by Judge Sotomayor’s explanation of her statute-of-limitations ruling.
I’ll also note that Sotomayor invoked her private-practice litigation experience in the intellectual-property area to argue that she has an appreciation for property rights. I trust that she’ll agree that her volunteer experience with PRLDEF is even more revealing of her sympathies.
