Tenth Circuit Summary

The Tenth Circuit (Colorado, Kansas, New Mexico, Oklahoma, Utah, and Wyoming) has 12 active judgeships. All of them are filled.

The court has 7 judges appointed by Democratic presidents (Obama 5, Biden 2) and 5 by Republican presidents (GW Bush 3, Trump 2).

Two Republican appointees—Harris Hartz and Timothy Tymkovich—are eligible to take senior status. Jerome Holmes will become eligible in late 2026, but his term as chief judge continues until 2028.

Among the Democratic appointees, Scott Matheson is senior-eligible, and four others will become so during Trump’s second term: Carolyn McHugh (March 2026), Robert Bacharach (May 2026), Gregory Phillips (January 2027), Moritz (July 2027).
