Justice Kagan Celebrated Obamacare Passage

Drudge is leading with a CNS News story about newly revealed e-mails showing Kagan’s involvement with Obamacare was even more extensive than previously believed. In one of the e-mails, Kagan (not normally so liberal with her punctuation) reacts to news that Obamacare would pass by telling Professor Laurence Tribe “I hear they have the votes, Larry!! Simply amazing.” Yet she has given no reason for us to believe that she will recuse herself when the Court decides the constitutionality of that law. As I explained in this white paper, Kagan is trying to get away with playing coach and umpire in the same game.
