Obama Defends Constitutionality of Obamacare

As Jay noted yesterday, liberals have been complaining that it would be hypocritical for conservative justices to overturn Obamacare, because doing so, they argue, would constitute legislating from the bench.

At today’s press conference with Canadian prime minister Stephen Harper and Mexican president Felipe Calderon, President Obama got in on the action. He said that he’s “confident the Supreme Court will uphold the law,” because “in accordance with the precedent out there, it’s constitutional.” He said, “I’d just remind conservative commentators that for years what we have heard is that the biggest problem on the bench was judicial activism, or a lack of judicial restraint — that an unelected group of people would somehow overturn a duly constituted and passed law. Well, this is a good example.”
