Later this week, the Supreme Court justices are scheduled to decide whether to grant review in the case challenging Harvard’s use of racial and ethnic preferences in its admissions. They met about this last June, too (the Court decided then to request the opinion of the solicitor general on what it should do, which last month was filed and then convincingly rebutted) and, for the reasons I lay out here, the Court should take the case.
